The US Department of Justice is expected to recommend that marijuana be rescheduled as a Schedule III controlled substance, a classification shared by prescription drugs such as ketamine and Tylenol with codeine. The standard rulemaking process is lengthy, is subject to a public comment period, and could take months to complete. However, rescheduling marijuana will not solve that federal-state conflict, the Congressional Research Service noted in a January 16 brief. In an emergency request last month, Navarro asked the Supreme Court to let him remain free while he challenged his conviction at the federal appeals court in Washington, DC. Supreme Court rules allow parties whose emergency applications are denied by a single justice to resubmit to another justice. The court denied the request on Monday without comment.
